TERMS AND CONDITIONS

Kiteloop, acting as the Agency, shall guarantee the execution of the travel program. The Client is obligated to provide any information which is required for the reservation process.

 

Reservation and payment

By making an ONLINE reservation/booking via the Agency web page booking system, the Client is expected to pay the full amount at once for all products.

By making a DIRECT reservation/booking via trip inquiry form, by e-mail, phone, fax or in person in the Agency, the Client is given the option of paying the 50% deposit of the package value, and the remaining 50% of the amount no later than 30 days prior to the commencement of the trip itself.

All credit card payments are SECURE and PROTECTED with the highest possible levels of security provided by the SSL Certificate.
If your choice of payment will be by Credit Card, you need to agree to leave your credit card data in Secure Vault even if you have to wait for your booking confirmation.

By paying the first installment and/or by paying a part of the package price containing Client’s basic data and information on the program the Client is paying for, the Client shall accept in its entirety, and confirm that all items of these Terms and Conditions have been understood, therefore everything that is written herein shall become legally binding on both the Client and the Agency.

Pricing and content

The Agency shall reserve the right to make modifications to the prices made public in case of drastic changes in hotel prices, transport prices and other services. The Client’s consent is not needed in cases where the package price has been increased up to 5%. At price increase surpassing 5%, the Client is entitled to cancel the agreement without having to cover any losses.

The prices of programs are listed in Euro. The prices in other currencies are liable to exchange rate fluctuations. The price is based on accommodation in two-bedded rooms, and in case the Client prefers to be alone in the room or chooses different type of accommodation, the Client is obliged to make an extra payment for chosen accommodation.

The package holiday (kitesurfing summer holidays) price usually includes (unless the program reads otherwise) accommodation and half-board, other meals as stated in the program, transfers, adventurous activities contained in the holiday program (SUP, cycling, hiking etc.) with all appertaining equipment and a guide. The prices of one-day and half-day excursions (day adventures) usually include (unless the program reads otherwise) transfers, adventurous activities contained in the trip program (SUP, cycling, hiking etc.) with all appertaining equipment and a guide. The prices do not include (unless the program reads otherwise) optional excursions, personal spending and drinks with any meals except breakfast.

Cancellation of travel

ALL cancellations must be in writing – by e-mail.

1. Kitesurfing Summer Holidays & Kids Kitesurfing Camp:

If the Client should cancel or abort the travel, all Client’s cancellations must be in writing – by e-mail . The written cancellation date shall be the basis for the compensation of cancellation costs which shall be collected by the Agency as per conditions set forth below (percentage of total arrangement price):

30 or more days prior to arrival: 10%
29-22 days prior to arrival: 25%
21-15 days prior to arrival: 40%
14-8 days prior to arrival: 80%
7-0 days prior to arrival or no show: 100%

Failing to make appearance and travel without prior cancellation shall entitle the Agency to withhold 100% of the payment made regardless of the reason or reasons for the cancellation.

2. IKO Training courses:

If the Client should cancel or abort the training, all Client’s cancellations must be in writing – by e-mail. Agency will not compensate for canceled training.
Failing to make appearance and travel without prior cancellation shall entitle the Agency to withhold 100% of the payment made regardless of the reason or reasons for the cancellation.

3. Kitesurfing school:

If the Client should cancel or abort the training, all Client’s cancellations must be in writing – by e-mail. The written cancellation date shall be the basis for the compensation of cancellation costs which shall be collected by the Agency as per conditions set forth below (percentage of total arrangement price):

8 or more days prior to arrival: 0%
2-7 days prior to arrival: 50%
1 day prior to arrival or no show: 100%
Failing to make appearance and travel without prior cancellation shall entitle the Agency to withhold 100% of the payment made regardless of the reason or reasons for the cancellation.

Agency cancellation policy

The kitesurfing holiday day-to-day itineraries are subject to change depending on group abilities and preferences, weather conditions, other acts of God, special events of interest and similar. For Client’s safety and comfort reasons, the Agency reserves the right to alternate program without prior notice. In case of major changes or cancellations of a specific program booked by the Client, the Agency will advise the Client as soon as possible and provide the following options:
a) Client may accept a new departure date or destination
b) Client may accept a replacement package/excursion of equivalent or closely similar itinerary
c) Client may cancel his/her booking altogether and receive a full refund of the money paid
The Client is obligated to inform the Agency of his/her decision within 7 days of the offer. If the Client does not, the Agency will book a replacement package/excursion.

In the unlikely case of extreme weather conditions, extraordinary circumstances, which could not have been foreseen or avoided or have occurred immediately before the start of the trip, the Agency will reschedule the activity for a day or two prior or after the date booked, if possible. If the change is not possible, the payments will be refunded in full.

Insurance

For all kitesurfing school day activities and kitesurfing holiday packages organized by the Agency, Kiteloop is insured with the LOVCEN OSIGURANJE – insurance company.

Casualty and disease insurance, risk of damage and baggage loss insurance, voluntary health insurance for time spent on travel

The travel prices do not include casualty and disease insurance, risk of damage and baggage loss insurance, nor do they include voluntary health insurance. By making the payment for a training or a package holiday, which are integral to the Terms and Conditions herein, as well as the trip program, it is deemed that the Client(s) has/have thus been advised to take additional health insurances which can be purchased directly at an insurance company of one’s own choice.

Liability insurance

According to the Tourism Services Act, the Agency shall have a signed agreement with the insurer against liability for damage caused to the Client by failing to meet, partially failing to meet or meeting in a neglected manner obligations relating to the package holiday or kitesurfing school.

Personal information security

The Client provides personal information of his/her own free will. Personal information is required for processing requested services. The same information shall be used for inter-communication. The Agency is under obligation that the personal information of the Client will not be taken out of the country or given to a third party except for the purpose of carrying out requested services. The exception of passing on personal information to third parties refers to cancellation insurance or insurance against accidents and illness, insurance of lost luggage and health insurance for the duration of the trip both locally and abroad. Should the Client request insurance, the personal information of the Client will be passed on to the insurance company. The personal information will be kept in a database in accordance with the management’s decision on the method used for collecting, processing and securing personal information.

Complaints and refund claims

If the program services are incomplete or executed below standard and in low quality, or if the Client is not satisfied with the accommodation, equipment or service provided, he/she should contact an Agency employee (head instructor/instructor/guide/representative) immediately in order to find a satisfactory change or replacement. Refund claims will be considered invalid unless the Agency was notified on time. All refund claims must be submitted to the Agency in written, within 7 days of the completion of the trip. The Client is entitled to compensation in the amount of real value of services that have not been provided, whereas the highest indemnity per complaint may amount to the amount of the package holiday price. The Client shall waive the right to ideal compensation. All and any possible disputes shall be settled at a Belgrade based court.

Client is obligated to:

Have valid travel documentation
Respect and abide by all customs and foreign exchange regulations of the destination country
Advise the Agency of any form of disability or impairment, which may restrict the enjoyment of the Client ‘s holidays
Provide the document which confirms payment of service (the voucher, bank receipt or excursion ticket received by mail, e-mail or in person) to the service provider
Enquire whether or not he/she requires a visa for Serbia or Montenegro as well as neighbouring countries if travelling through them is included in the itinerary.
If the Client does not follow these regulations, he/she will be held responsible for any expenses or damages. By confirming a reservation, the Client is obligated to pay the service provider on the spot for any damage(s) he/she may have caused.

Court jurisdiction

Should a Client not be satisfied with the manner in which his/her complaint was handled, he/she has the right to judicial arbitration. The Client and the Agency will aim to settle possible law suits in the application of this Agreement and if an agreement cannot be reached, the issue will become subject to the decision of the Belgrade Court jurisdiction, under the authority of the laws of the Republic of Serbia.
